Terms & Conditions


1. Scope of Services

Chantler Transport (“we,” “us,” “our”) provides transportation and logistics services—via our brokerage and fleet—across Canada, the United States, and Mexico. Services include shipping, warehousing (as requested), and any supplementary logistics support.


2. Role & Authority

When acting as an agent, we arrange services via third-party carriers; liability is limited to the carrier’s scope of service. If a transport document names us as the “carrier,” its terms prevail over these Conditions.


3. Customer Obligations
  • Customers must ensure goods are properly packed, accurately labelled, and safe for transport.
  • All shipment details (weight, dimensions, marks) must be truthful and complete.
  • Hazardous or dangerous goods must be clearly disclosed and properly marked; failure to do so indemnifies us from related liabilities.

4. Insurance & LiabilitY
  • Customers may request us to arrange cargo insurance; coverage is subject to policy terms.
  • If customers arrange their own insurance, we’re not liable for uninsured losses.
  • Liability limitations follow standard freight forwarding practices, usually defined in transport documents or governed by SDR-based (Special Drawing Rights) limits.

5. Claims, Time Limits & Force Majeure
  • Loss/damage claims must be filed within 7 days of delivery.
  • Delay or non-delivery issues must be reported within 45 days of expected delivery.
  • Claims not made within these periods are time-barred.
  • We are not liable for events beyond our control (e.g. natural disasters, strikes, government actions). In such events, we may adjust services/pricing accordingly.

6. GST/HST & Tax Considerations
  • Domestic Canadian services: GST or HST applies based on destination (provincial HST if applicable; otherwise GST)
  • International freight (exports/imports or through Canada): Services may be zero-rated if criteria are met
  • Fuel surcharges and incidental fees (warehousing, packing) follow the same tax status as core freight charges

7. Billing & Invoicing
  • Invoices include GST/HST where applicable and separate line items for surcharges (e.g., fuel, insurance) as relevant.
  • Payment terms (e.g., “net 30 days”) to be specified clearly on the invoice or contract.

8. Liens & Retention

We reserve the right of lien and to detain goods for overdue charges. Unpaid goods may be sold after notice per applicable jurisdiction guidelines.


9. Applicable Law & Jurisdiction

These Terms & Conditions are governed by the laws of Canada and the province where Chantler Transport has its principal place of business (Innisfil, Ontario). Disputes are subject to jurisdiction of the Ontario courts.


10. Electronic Communications

Electronic messages (emails, chat, EDI, etc.) have full legal effect as governed by applicable e-commerce laws (e.g. Uniform Electronic Commerce Act).
